 Deposition Officer Service
Our Deposition Officer(s) meet all statutory qualifications to be designated as a Deposition Officer pursuant to Evidence Code § 1560(e), Code of Civil Procedure § 2020.420, and Business and Professions Code § 22451(g). Our seasoned, licensed and bonded Deposition Officers provide accurate, secure, and compliant handling of subpoenaed records for attorneys, paralegals, law firms, and self-represented litigants throughout California.
We specialize in fast, efficient, and cost-effective custodial coordination, secure electronic production, and meticulous chain-
of-custody practices from issuance through delivery.   

Types of Subpoenas:

  • Civil Subpoena for Personal Appearance at Trial or Hearing;
  • Subpoena - Expert Testimony;
  • Civil Subpoena (Duces Tecum) for Personal Appearance and Production of Documents, Electronically Stored Information,and Things at Trial or Hearing;
  • Deposition Subpoena for Personal Appearance;
  • Deposition Subpoena for Production of Business Records;
  • Deposition Subpoena for Personal Appearance and Production of Documents and Things.

What is a Subpoena?

     A subpoena is a court-issued or attorney-issued legal command that requires an individual or entity to produce documents, allow inspection of records, or appear to give testimony in a legal proceeding. Failure to comply absent valid objection, notice, motion to quash, or protective order may result in penalties or contempt sanctions.

Services Offered:

Our Office offers  two (2) types of Deposition Officer services:
Deposition Officer Only (Client-Prepared Documents)
For clients who prepare their own subpoenas and notices, our Deposition Officer will:
  • Calendar on-site, mail-in, or electronic records production;
  • Receive and review original responsive documents;
  • Certify, copy, and/or convert to secure encrypted PDF;
  • Apply electronic Bates labeling or numbering as needed;
  • Release secured encrypted electronic copies to authorized counsel or in pro per litigants; and 
  • Maintain custody of original production documents.
Important Disclaimer: Deposition Officer Only services do not include preparing subpoenas, Notice to Consumer or Employee, or related paperwork. Clients who elect to prepare their own documents assume full responsibility for legal sufficiency, accuracy, and compliance. Our office is not responsible for delays, voided subpoenas, or defects arising from client-prepared documents.

Deposition Officer With Document Preparation
For clients who prefer full preparation and coordination, our Deposition Officer will:
  • Prepare the Subpoena for Production of Records; 
  • Prepare and serve Notice to Consumer or Notice to Employee (when applicable);
  • Serve Notice to Consumer or Employee (when applicable);
  • Research Agent for Service of Process (if any) via the California Secretary of State database;
  • Calendar on-site, electronic, or mail-in production and coordinate proactively with the facility or records custodian;
  • Receive, certify, copy, and convert records to a secured encrypted PDF format;
  • Apply electronic Bates numbering or labeling, if applicable;
  • Release secured and encrypted PDF copies to authorized counsel and/or self-represented litigants; and
  • Maintain original records in secure custody.
*Please Note: Our office is not responsible for inaccuracies when provided an incorrect Deponent legal name or entity name.

Fees, Costs & Exclusions: 
Please take note of the following:
  • Deposition Officer fees do not include process service upon the Deponent or Custodian; 
  • Custodian/Records fees, witness fees, or facility charges (if any) are separate and payable by the client; and 
  • Rush service, on-site productions, voluminous productions, and mailing charges (if any) may incur additional costs.

Neutral Third-Party Role:
      Our Deposition Officer(s) act as a neutral third-party for purposes of production and records handling and do not represent any party in an underlying matter.
